Resolved that:

The Audited Statement of Accounts for 2015/16 being the financial year ended 31 March 2016 be approved.

Representations regarding the 2015/16 Financial Statements be approved and communicated to the Appointed Auditor.

Councillor P Williams referred the Council to the ‘Data Protection Reform – The General Data Protection Regulations (GDPR) 2016’ report.

Councillor Williams stated that the creation of the Data Disclosure and Records Officer post would ensure that the Data Protection Officer would be able to undertake the vast amount of preparatory work as set out in Paragraph 4 of the report. 

The post would assume the management of the Council’s responsibilities provided under the Freedom of Information Act 2000, the Environmental Information Regulations 2004, the Data Protection Act 1998 (until the GDPR becomes enforceable in May 2018) and other records management and data disclosure enquiries.

Councillor Williams further stated that he supported the recommendations subject to two further recommendations.

Resolved that:

(a)  The proposals for the implementation of the General Data Protection Regulations be approved

(b)  The creation of the Data Protection Officer post in accordance with Articles 37-39 of the GDPR be approved and an appointment to the role be made in accordance with Council Policy and Procedures

(c)  The funding for the Data Protection Officer is found for 2016/2017 from the Efficiency Reserves and thereafter into the Base Budget

(d)  The creation of a temporary post (initially on a one year contract) titled the Data Disclosure and Records Officer be approved and an appointment to the role be made in accordance with the Council Policy and Procedures

(e)  A further report to be placed before Council in the winter of 2017/2018 in respect of progress on the implementation of the GDPR and any further consequences of ensuring compliance with the Regulations

The Mayor advised that there was no business deemed urgent.
