Members are reminded of their personal responsibility to declare any personal and prejudicial interest in respect of matters contained in this agenda in accordance with the provisions of the Local Government and Finance Act 1992 relating to Council Tax, the Local Government Act 2000, the Council’s Constitution and the Members Code of Conduct




(a)  Members are reminded that they must identify the item number and subject matter that their interest relates to and signify the nature of the personal interest and


(b)  Where Members withdraw from a Meeting as a consequence of the disclosure of a prejudicial interest they must notify the Chair when they leave

Geraint Morgan referred the Committee to the ‘Cyfarthfa 69’ report.


The Committee then walked Cyfarthfa 69.


Resolved that:


The application be rejected as on the balance of probability insufficient evidence has been provided in support of the application to record the claimed Right of Way and to advise the applicant that their application has been rejected and that they may appeal in writing against the decision of the Council to the Planning Inspectorate within 28 days from the date of the decision letter.

Geraint Morgan referred the Committee to the ‘Gurnos 1’ report and the Committee were advised that under Paragraph 3.7 of the report the first sentence should read ‘uncertainty’ and not ‘certainty’.


The Committee then walked Gurnos 1


Resolved subject to the foregoing that:


(a)  The Council dedicate the route of Gurnos 1 as a bridleway

(b)  That a Dedication agreement be drawn up in respect of the route and once the relevant agreement has been sealed by the Council that a site notice be placed at both ends of the route and that a Definitive Map Modification Order under section 53(3)(a)(iii) Wildlife and Countryside Act 1981 be prepared in order to record the route on the Council’s Definitive Map and Statement


Recommendations 2.3, 2.4 and 2.5 were also considered and it was


Resolved that:


Recommendations 2.3, 2.4 and 2.5 as outlined in the report be refused.


Any other Business deemed urgent by the Chair


Communicating Decisions


The Committee agreed that all Ward Members in the Ward where a decision is made in respect of a Right of Way be advised of the decision.
