·         Council dedicate the route as a bridleway.

 

·         A dedication agreement be drawn up in respect of the route and once the relevant dedication agreement has been sealed by the Council that site notices be placed at each end of the route and that a Definitive Map Modification Order under Section 53(3)(a)(iii) Wildlife and Countryside Act 1981 be prepared in respect of this route.

RESOLVED that:

 

In respect of Troedyrhiw 112:

 

a)         On the balance of probabilities there is sufficient evidence to support that the route marked with a bold line between Points A – B – C – D – E – F – G – H – I on the Plan, Troedyrhiw 112, has been used for such period so as to raise presumption that it has been dedicated as a bridleway, and that the evidence has not been rebutted by other evidence.

 

b)         on confirming (a) above to approve the making of a Definitive Map Modification Order to show Troedyrhiw 112 as a bridleway.

 

c)         to approve the confirmation of the Definitive Map Modification Order made as a result of (b) above provided no objections or representations are made within the prescribed period or if any objections or representations so made are withdrawn.

 

d)            if any objections or representations are made within the prescribed period and not subsequently withdrawn then to refer the relevant Order to the Planning Inspectorate for determination.

 

In respect of Troedyrhiw 119

 

a)         On the balance of probabilities there is sufficient evidence to support that the route marked with a bold line between Points K – L on the Plan, Troedyrhiw 112, has been used for such period so as to raise presumption that it has been dedicated as a bridleway, and that the evidence has not been rebutted by other evidence.

 

b)         On confirming (a) above to approve the making of a Definitive Map Modification Order to show Troedyrhiw 119 as a bridleway.

 

c)         To approve the confirmation of the Definitive Map Modification Order made as a result of (b) above provided no objections or representations are made within the prescribed period or if any objections or representations so made are withdrawn.

 

d)         If any objections or representations are made within the prescribed period and not subsequently withdrawn then        to refer the relevant Order to the Planning Inspectorate for determination.

 

In respect of Troedyrhiw 9:

 

a)         On the balance of probabilities there is sufficient evidence to support that the route marked with a dashed line between Points P – J, a bold line between points J – K and a dashed line between points K – N on the Plan, Troedyrhiw 112, has been used for such period so as to raise presumption that it has been dedicated as a bridleway, and that the evidence has not been rebutted by other evidence.

 

b)         on confirming (a) above to approve the making of a Definitive Map Modification Order to show Troedyrhiw 9 as a bridleway.

 

c)         to approve the confirmation of the Definitive Map Modification Order made as a result of (b) above provided no objections or representations are made within the prescribed period or if any objections or representations so made are withdrawn.

 

d)         if any objections or representations are made within the prescribed period and not subsequently withdrawn then        to refer the relevant Order to the Planning Inspectorate for determination.
