RESOLVED that:

 

An agreement be entered into under Section 25 Highways Act 1980 between Redrow Homes Limited and the County Borough Council to create the footpath as described above.

 

In the event of the Public Creation Agreement being executed, a Definitive Map Modification Order be made pursuant to Section 53(3)(a)(iii) of the Wildlife and Countryside Act 1981, to amend the Definitive Map and Statement accordingly to reflect the creation of the footpath referred to above, such footpath being a right of way on land to which the right subsists is a footpath.

RESOLVED that:

 

a.    The footpath be upgraded to a bridleway.

 

b.    On confirming (a) above to approve the making of a Definitive Map Modification Order to show it as a bridleway.

 

c.    Approve the confirmation of the Definitive Map Modification Order made as a result of (b) above provided no objections or representations are made within the prescribed period or if any objections or representations so made are withdrawn.

 

d.    If any objections or representations are made within the prescribed period and not subsequently withdrawn then to refer the relevant Order to the Planning Inspectorate for determination.
